日本政府は、国際的なリモートワーカーを対象とした新たなデジタルノマドビザ制度を2024年3月31日に開始しました。この制度の要件に該当する場合、リモートワークを行う個人には「特定活動５３号」が、その配偶者や子どもには「特定活動54号」がそれぞれ付与されます。
このビザを取得することにより、日本国内に雇用主や受入機関が存在しない場合であっても、最長6ヶ月間、日本からのリモートワークが可能となる見込みです。対象者は年収が1,000万円以上であること、適切な保険に加入していることなどの要件を満たす必要があります。さらに、このビザの対象となるのは、租税条約の締結国かつ査証免除国・地域の内、国が指定した国の国籍を持つ人々に限られます。
現時点で公表されている制度の枠組みは以下の通りです。

これまで日本においてはデジタルノマドやリモートワークを支援するビザの制度が存在しておりませんでしたが、Covid -19 下でのリモートワークが広く普及した結果、国内外からのノマドビザへの期待が高まっていました。この背景を受け新設された制度は革新的な取り組みであると言えます。一方で、このビザによる滞在可能な期間は６か月間と非常に限定的でかつ、延長は認められていません。このため、このビザは基本的に短期間の滞在を目的としたものである点を理解しておく必要があります。
また、この在留資格の保持者は、中長期在留者には該当しないことから、住民票作成の対象外となり、社会保険や年金等の対象にはならないことについても留意が必要です。同時に外国の雇用主においては、従業員が日本で勤務することによって引き起こされる可能性のある恒久的施設(Permanent Establishment)認定のリスクについて配慮する必要があります。尚、本制度に係る法改正は20024年3月31日付で施行されております。
