Personal identification number, a 12-digit number issued by the Vietnam Ministry of Public Security (“MoPS”), will replace the current tax code number issued by the Vietnam tax authority for purposes of tax filing and payment. This replacement is applied to Vietnamese individual taxpayers and will take effect from 1 July 2025. Foreign taxpayers are not affected by this change at this juncture.
On 23 December 2024, the Ministry of Finance (“MoF”) issued Circular 86/2024/TT-BTC (“Circular 86”) regulating tax registration. Circular 86 provides detailed guidance on which entities and individuals in Vietnam are required to perform taxpayer registration directly with the tax authorities and the registration dossier requirements. But for the purpose of this news alert, we wish to highlight an important key update in relation to Vietnamese individual taxpayers.
Effective from 1 July 2025, Vietnamese individual taxpayers will no longer need to obtain a tax code from the tax authorities for tax filing and payment purposes. Instead, their 12-digit PIN, issued by the MoPS will be used for their tax filing purposes. Similarly, the 12-digit PIN of their dependent(s) will also need to be used when claiming dependent relief. This change aims to align with the Vietnamese Government’s digital transformation initiatives. But note that a notification form (i.e. Form 05-DK- TCT issued under Circular 86) will need to submit to the provisional tax authorities notifying the usage of the 12-digit PIN. It is expected that guidance on implementation steps for Circular 86 will be issued soon.
Foreign taxpayers are not affected by this change at this juncture and will need to continue to submit tax code registration for them and their dependent(s) to obtain a a tax code from the provisional tax authorities.
Circular 86 is effective from 6 February 2025 and will replace Circular 105/2020/TT-BTC providing guidance for tax registration promulgated by the MoF dated 3 December 2020. Although Circular 86 takes effect on 6 February 2025, the replacement of ID number issued by the MoPS will only be applicable from 1 July 2025.
