Summary
U.S. Citizenship and Immigration Services (USCIS) announced that they will conduct a second lottery to select additional registrations to reach the FY 2024 numerical allocations using a random selection process from the previously submitted FY 2024 H-1B cap registrations.
The detail
In March 2023, USCIS conducted an initial random selection on properly submitted electronic registrations for the FY 2024 H-1B cap. After the initial random selection, USCIS released the H-1B lottery results and informed applicants to submit H-1B petitions on behalf of their candidates who were selected for the FY 2024 H-1B cap. In the initial H-1B lottery round, USCIS selected 110,791 registrations, which is 16,809 fewer than the previous fiscal year (2023).
As noted by USCIS, there was a significant increase in the number of registrations submitted for the FY 2024 H-1B cap compared to prior years, due to an increase in beneficiaries for whom more than one registration was filed. USCIS recently determined that they would soon conduct a second lottery in order to reach the FY 2024 numerical allocations using the same random selection method as the initial random selection process. Once the random selection process is completed, myUSCIS accounts will update the application case status for the beneficiaries registered to either “selected” or “non-selected.” Those who are selected will receive a selection notice, which includes details of when and where to file the H-1B petition. USCIS will announce once they have completed this second selection process and have notified all prospective petitioners with selected registrations from this round of selection.
What this means
Employers will be promptly notified about results by Vialto teams once the second random selection is completed and myUSCIS accounts are updated. For those candidates who are selected, Vialto teams will work together with employers to collect the required documentation to ensure that H-1B cap petitions are filed timely.
