United States | FY2025 H-1B Cap registration is now open
Summary
The initial registration period for the FY 2025 H-1B cap opened at noon Eastern on March 6, 2024, and will run through till noon Eastern on March 22, 2024. During this period, prospective petitioners and their representatives, if applicable, must use a USCIS online account to register each beneficiary electronically for the selection process and pay the associated registration fee for each beneficiary.
The detail
On February 28, 2024, U.S. Citizenship and Immigration Services (USCIS) launched the new myUSCIS organizational accounts and a new organizational account is required to participate in the H-1B Electronic Registration Process starting in March 2024.
Under the new electronic registration process, USCIS will require registrants to provide valid passport information or valid travel document information for each beneficiary. The passport or travel document provided must be the one the beneficiary, if or when abroad, intends to use to enter the United States if issued an H-1B visa. Furthermore, each beneficiary must only be registered under one passport or travel document.
Following the 14 calendar-day registration period, USCIS will run a lottery to select the registrants that will be eligible to file the H-1B cap-subject petitions from April 1, 2024. While paper filed forms will be accepted, USCIS will also begin accepting online filing for H-1B cap petitions and associated Forms I-907 for petitioners whose registrations have been selected from April 1, 2024. USCIS has confirmed that it will provide the lockbox filing addresses for paper filed forms in late March 2024.
What this means
The initial registration period is for a minimum of 14 calendar days each fiscal year and it is important to adhere to the requirements of the new electronic registration process as the H-1B selection process will be run on properly submitted electronic registrations.
Furthermore, only those with selected registrations are eligible to file H-1B cap-subject petitions, for which petitioners will also have to adhere to the new fee schedule released by USCIS and effective April 1, 2024, and use the 04/01/24 edition of Form I-129.
