United Kingdom | Introduction of hybrid and remote working reporting requirements

Summary

UK Visas and Immigration (UKVI) have updated their sponsor guidance to take into account  post-pandemic methods of working and have now introduced a requirement to report if a migrant will be working fully remotely or  undertaking a hybrid working pattern. 

The Detail

The sponsor guidance now refers to a migrant’s ‘normal work location’ rather than ‘work location’. Working remotely from home on a permanent or full-time basis (with little or no requirement to physically attend a workplace) and a hybrid working pattern are now included as appropriate ‘normal work locations’.  

A hybrid working pattern is defined in the guidance as where ‘a worker will work remotely on a regular and planned basis from their home or another address such as a work hub space that is not a client site or an address listed on your licence’ 

Sponsors must now report via the Sponsor Management System (SMS) if a migrant is working via one of these arrangements. They do not however need to report day to day changes in work location (e.g. if a worker occasionally works at a different branch or site or from home), only changes to the migrant’s regular working pattern.
