Qatar | Nationalisation Law in the private sector
Summary
His Highness Emir Sheikh Tamimmi bin Hamad Al Thani of the State of Qatar, has issued Law No.12 of 2024 (‘The Law’) concerning the localisation of jobs in the private sector, with the aim of creating more opportunities for Qatari nationals. The Law is expected to take effect six months after its publication in the Official Gazette.
The Detail
The Law aims to significantly boost the participation of the national workforce in private sector institutions and companies, creating new employment and career opportunities for Qataris.
The Law includes enhancing the labour market’s appeal to the national workforce, increasing companies’ ability to attract and integrate citizens, and ensuring job stability for Qatari nationals.
The Ministry of Labour has further clarified the entities that will be subject to nationalisation under the law, including:
– Employers who are individuals managing private establishment registered in the commercial register;
– Commercial companies operating in the State, whether State-owned, State participated or privately owned
– Private non-profit institutions, sports organisations, associations, and similar entities.
The Ministry underscored that The Law has addressed numerous challenges that have previously hindered nationalisation efforts, establishing the necessary conditions and procedures to make the private sector more attractive to Qataris, enabling them to achieve their professional and career ambitions.
Key provisions of the law include:
– Providing financial incentives to beneficiaries;
– Offering various benefits, facilities, and privileges to entities covered by the nationalisation scheme under The Law
– Employing, training and qualifying Qataris seeking employment, in accordance with the policies, plans and programs set by the MInistry.
What this means
The Law aligns with Qatar National Vision 2030, particularly the human development pillar, by promoting and encouraging employment and training opportunities for Qatari citizens.
It is important for privately owned companies to comply with the nationalisation policies once in effect, and the requirements that need to be satisfied in order to comply with localisation requirements
