Poland | Extension of temporary protection for Ukrainian nationals
Summary
Citizens of Ukraine can count on the extension of their legal stay on the basis of the so-called Special Acts until June 30, 2024 – as indicated in the draft amendment to the Act of March 12, 2022, published today, regarding assistance to citizens of Ukraine in connection with an armed conflict on the territory of this country (hereinafter referred to as the Special Act).
Meanwhile, third-country nationals who are not citizens of Ukraine and are subject to temporary protection due to fleeing the war in Ukraine can count on the extension of temporary protection certificates until March 4, 2025.
The Detail
Today, a draft amendment to the Act of March 12, 2022 on assistance to citizens of Ukraine in connection with an armed conflict on the territory of this country was published on the website of the Government Legislation Center. It assumes the extension of the legal stay of Ukrainian citizens fleeing the war until June 30, 2024.
Until this date, the following would also be extended: the validity of the national visa of the Ukrainian citizen and the temporary residence permit granted to the Ukrainian citizen before the outbreak of the war.
Meanwhile, the European Commission decided to extend the temporary protection until March 4, 2025. Until that date the validity of temporary protection certificates issued to citizens of third countries (non-Ukrainian citizens) who, at the outbreak of the armed conflict, benefited from temporary protection in Ukraine or stayed there on the basis of a permanent residence permit and who came to Poland fleeing from hostilities, are extended.
What this means
According to the information in the justification for the amendment to the Special Act, the government is to continue work on further extension of temporary protection for the Ukrainian nationals in accordance with the guidelines of the European Commission. In the meantime, the Special Act and other provisions of immigration law provide opportunities to legalise stay for Ukrainian citizens on standard terms (e.g. obtaining a residence and work permit for a period of 3 years). It is worth analysing your individual situation and considering other available solutions.
