Summary

On Friday 5 April 2024, the ADEM employment agency announced the publication of the 2024 list of shortage occupations in Luxembourg. This list has been published in the Official Journal (Journal Officiel du Grand-Duché de Luxembourg) and is also available on the ADEM website.

The detail

This list establishes the jobs that are most in demand among recruiters and for which very few (or no) candidates are available from ADEM. Luxembourg is currently experiencing a significant shortage of qualified candidates in 24 specific job sectors (compared to 30 last year), including finance, IT, engineering, health and personal care, social work, and business support services (human resources, accounting, audit, and legal advice).

To ensure that the list of shortage occupations corresponds as closely as possible to the reality of the job market, it is key that employers declare all their vacant positions to ADEM. This list is also used to better analyze the qualifications and skills that employers need and to organize targeted training courses for jobseekers in the identified professions.

What this means

1/ ADEM certificates issued faster for shortage occupations
Employers can make the application for a “foreign workforce” (main-d’œuvre étrangère) certificate directly when declaring a vacant position to ADEM, or subsequently, during the entire validity period of the offer. If the declared position corresponds to a profession on the list of shortage occupations, the certificate is issued within five working days following acknowledgment of receipt.

For jobs that are not on the list of labor shortage, the market test will continue to be carried out but with shorter deadlines. ADEM will have seven working days to check whether jobseekers fulfilling the profile required for the declared position are available. If no candidate can be proposed, the certificate will be issued, after the seven-day deadline, within the next five working days. If ADEM can propose candidates corresponding to the profile, they will have 15 additional working days to suggest candidates to the employer.

2/ Lower minimum salary threshold to apply for EU blue Card for shortage occupations
Foreign employees with a salary of minimum 70.762 euros (the salary threshold for shortage occupations for EU Blue Card holders has recently increased), and with a profession that is on the list of labor shortage, can be eligible for the EU Blue Card.

Recommended action

Employers hiring third country nationals should review the updated list of shortage occupations to check whether some of their occupations are listed there as they could benefit from hiring facilitation (no labor market test and potential eligibility to the EU Blue Card).
