Luxembourg | Increase of the threshold for the EU Blue Card

Summary
By Ministerial regulation of March 15, 2024, the salary threshold for EU Blue Card holders has increased as follow:

  • For non-shortage occupations: 88.452 euros (previously 84,780 euros).
  • For shortage occupations: 70.762 euros (previously 67,824 euros).

The detail 
EU Blue Card applicants in Luxembourg must have at least a 3-year University Degree and or justify at least five years of relevant professional experience. As of Sunday 24 March 2024, companies employing EU Blue Card holders will be required to pay the minimum gross salary of at least 88.452 euros unless the employee is working in an identified shortage occupation, in which case the salary minimum will be 70.762 euros.

The list of shortage occupations includes:

  • Credit analysis and banking risks
  • Banking customer management
  • Front office financial markets
  • Installation and restoration of roofs
  • Creation and restoration of facades
  • Management and engineering studies, research, and industrial development
  • Production management and engineering
  • Operating machining equipment
  • Installation and maintenance of industrial and operating equipment
  • Electronic installation and maintenance
  • Hygiene care, patient comfort
  • General nursing care
  • Psychology
  • Social Action
  • Education of young children
  • Socio-educational intervention
  • Defense and legal advice
  • Research in the sciences of the universe, matter, and life
  • Financial analysis and engineering
  • Accounting and financial audit and control
  • Management control
  • Accounting
  • Socio-economic studies and prospects
  • Business organization and management consulting
  • Human resources development
  • Management and product management
  • Information systems administration
  • Consulting and project management in information systems
  • IT studies and development
  • Expertise and technical support in information systems

What this means 
For initial and renewal applications, employers of foreign nationals seeking to obtain or renew a work permit after 24 March 2024 must increase the foreign national’s salary to comply with the new rule. Those who do not meet the threshold will be eligible for the standard local work permit (Salaried Worker Permit), for which a labor market test will need to be completed.

For pending applications, any file received before the publication date (24 March 2024) should be processed taking into consideration the previous threshold.

Recommended actions
Employers should review their population to check if they comply with the new threshold for highly skilled workers.
