From 2025, employers must ensure that posted employees carry valid ID, and from 2026, foreign companies must upload additional documents, including work permits and contracts, in the Danish PWD portal. As employer responsibilities are increasing, companies should review their obligations and plan accordingly.

Background

Foreign companies posting employees to Denmark must consider if a registration in the Register of Foreign Service Providers (RUT) is required. This requirement exists as a consequence of the Posted Workers Directives in the EU.

The Danish government has introduced expanded documentation requirements regarding third country nationals. Additionally, the Danish government is imposing further employer responsibility in relation to ensuring identification documents for employees in Denmark.

Identification documentation

As of 1 January 2025, employers must ensure that posted employees carry valid identification (passport, driver’s license, or health insurance card) for inspection by the Danish Working Environment Authority.

Expanded document requirements

Starting January 1, 2026, foreign companies posting third country nationals to Denmark must upload additional documents when registering in the Register of Foreign Service Providers (RUT) portal.

These additional documents include:
– Service contracts
– Employment contracts
– Residence and work permits

Previously, it was a requirement for employees to provide identification and now the employer can be sanctioned if this is not presented upon audit.

What to do next

Companies sending employees to Denmark should:

  1. Assess if a requirement to register in RUT has been triggered
  2. Assess if additional documentation is required
  3. Ensure that employees sent to Denmark are in possession of the appropriate identification documentation

In general, plan ahead and ensure that compliance is considered both regarding RUT but also in relation to social security, tax and immigration.
