Expanded visa exemption policy for business travellers to China

On November 24, 2023, the Chinese Ministry of Foreign Affairs made an important announcement regarding the implementation of an expansion of unilateral visa exemption for six countries.

Starting from December 1, 2023 until November 30, 2024, citizens holding ordinary passports from France, Germany, Italy, the Netherlands, Spain and Malaysia will enjoy a unilateral visa exemption when visiting China for short-term business, tourism, family visits, or transit purposes, for a duration of up to 15 days. It is important to note that the “15 days” period starts counting from the day following the arrival.

Besides it is worth mentioning that prior to this expansion, China had already implemented unilateral visa exemptions for citizens of Singapore, Brunei, and Japan. However, the visa exemption policy for Japanese passport holders has not yet been resumed following the travel restrictions imposed due to the pandemic.

Relaxed visa policy for Chinese nationals

On November 25, 2023, the French Ministry of Foreign Affairs made an announcement regarding a new visa policy for Chinese students. According to the announcement, Chinese students who have successfully obtained a master’s degree and completed at least one semester of study in France will now be eligible for a five-year multiple-entry visa. This new policy aims to facilitate easier travel and provide extended opportunities for Chinese students who have pursued higher education in France.

On November 27, 2023, the Prime Minister of Malaysia made an announcement regarding the implementation of a visa exemption for Chinese passport holders. Starting from December 1,
Chinese citizens with ordinary passports will be granted visa exemption when visiting Malaysia for tourism purposes, allowing them to stay for a maximum duration of 30 days. Further information regarding this policy will be disclosed at a later date.

What does this mean

The visa exemption policy has undoubtedly brought significant convenience for short-term visitors. However, it is important to recognize that along with this convenience comes potential risks in terms of immigration and tax compliance, particularly for short-term business travelers. It is crucial for companies to maintain diligent monitoring of cross-border travels, especially when employees are able to travel without a visa.

Additionally, it is essential to note that the stay under the visa exemption policy cannot be extended in China.
