This is the first time that this has happened as currently Right to Work checks are only required for employees. These proposed changes are in line with the government’s continued drive to increase immigration enforcement activity and prevent illegal working in the UK. They also further add to existing supply chain obligations, such as for tax.

The consultation is not about whether or not the changes will be implemented. Instead, responses will inform the preparation of guidance and the statutory code of practice that supports the scheme.
On the same day the consultation opened, the Home Office announced that arrests for illegal working are at their highest levels since records began.
How do I respond?
The consultation will run for 6 weeks and closes on 10 December 2025. UK businesses can respond by completing an online questionnaire or returning the downloadable version by email to: righttorentandrighttowork@homeoffice.gov.uk. Alternatively, please contact your usual Vialto Partners point of contact for assistance in preparing your response.
A number of sponsors have received emails from UKVI/GOV.UK regarding CoS usage within defined periods of time. The emails also warn of phishing scams via email leading SMS users to inadvertently share their log-in details to fraudsters resulting in Certificates of Sponsorship being applied for and assigned from their SMS account.
We have confirmation from the UKVI that the emails asking to check details are genuine. However, you should always check with your Vialto team before undertaking any action and take the necessary steps to see if the emails are from a genuine email address that is not misspelled.
What happens if I click on a link that is not from the Home Office?
SMS users who have received a phishing email and clicked on an unauthorised link are advised to take immediate steps to change their passwords and undertake a thorough review of their sponsor licence. Even where a phishing email has not been received, UKVI are still advising that a thorough review of the sponsor licence is undertaken to ensure there has been no unauthorised activity on the licence, such as CoS requests or changes to key personal details. If this takes place, please contact Vialto immediately.
