UAE | Suspension of temporary labour card from MOHRE

Summary

Effective immediately, the Ministry of Human Resources and Emiratisation (MOHRE) has suspended the issuance of Temporary Labour Cards (TLC) for certain UAE Residence Permit holders.

The Detail

Previously, a company could apply for a TLC to allow an individual to work short-term in the Mainland jurisdiction for a period of six months, provided the individual held a valid UAE Residence Permit sponsored by either a Relative or an Employment Residence Permit issued by a Free Zone, semi-government or government jurisdiction. Companies previously utilised the TLC option for short-term employment opportunities and mostly commonly in the following scenarios:

● Internships;
● Short-term project based work;
● Individuals who held a Residence Permit sponsored by a Relative and was offered short-term employment for a duration of less than six months; and
● Individuals who were already employed by a Free Zone entity and seconded to a client site in the Mainland entity.

We now await further details from the MOHRE with respect to alternative work permit options for companies who are impacted by this change.

What this means

Companies should review their current workforce, assess if there are any employees who are holding a TLC under this category and strategise any upcoming TLC expiries, as the company will be unable to renew or apply for a new TLC.

Depending on the situation, companies may need to look at the alternative possibilities of applying for a Part Time Labour Card or an Employment Residence Permit to enable their employees to work for their Mainland entity, where the TLC is no longer an option.
