Mexico | Proposal to reduce Mexican hiring quota and increase foreign workforce

Summary

An initiative to reform the Federal Labor Law (LFT) was recently presented in the Chamber of Deputies, seeking to modify the rules on the proportion of Mexican and foreign workers that can be hired by companies in Mexico.

The detail

The initiative aims to facilitate the integration of migrants into the labor market, particularly those who are in a vulnerable situation in the country.

Currently, Article 7 of the Federal Labor Law establishes that at least 90% of a company’s workers must be Mexican, allowing a maximum of 10% foreign personnel in technical and professional positions.

The objective of this initiative is to promote the economic integration of the migrant population and improve their access to formal employment.

In addition, the Mexican labor market is experiencing difficulties in filling vacancies in various sectors, which is also fueling the debate on expanding access to employment for foreign workers.

The initiative proposes the following adjustments to the labor framework:

  • Reduce the minimum quota of Mexican workers from 90% to 75%.
  • Allow up to 25% of the workforce to be made up of foreign workers, giving priority to migrants in vulnerable situations.
  • Maintain the obligation for foreign workers and employers to participate in the training of Mexican workers.
  • Maintain exceptions for executive, administrative, and general management positions, provided that trained Mexican workers are not excluded.
  • The proposal is currently in the legislative initiative stage and must be discussed and eventually approved by Congress to enter into force. At this time, it does not constitute a reform in force.

México | Iniciativa legislativa propone reducir cuota de contratación de personal mexicano y ampliar participación de trabajadores extranjeros

Resumen

Recientemente se presentó en la Cámara de Diputados una iniciativa de reforma a la Ley Federal del Trabajo (LFT) que busca modificar las reglas sobre la proporción de trabajadores mexicanos y extranjeros que pueden ser contratados por las empresas en México.

El detalle

La iniciativa pretende facilitar la integración laboral de personas migrantes, particularmente aquellas que se encuentran en situación de vulnerabilidad en el país.

Actualmente, el artículo 7 de la Ley Federal del Trabajo establece que al menos el 90% de los trabajadores de una empresa deben ser mexicanos, permitiendo un máximo de 10% de personal extranjero en puestos técnicos y profesionales.

El objetivo de esta iniciativa, es favorecer la integración económica de la población migrante y mejorar su acceso al empleo formal.

Además, el contexto del mercado laboral mexicano muestra dificultades para cubrir vacantes en distintos sectores, lo que también impulsa el debate sobre ampliar el acceso al empleo para trabajadores extranjeros.

La iniciativa plantea los siguientes ajustes al marco laboral:

  • Reducir la cuota mínima de trabajadores mexicanos del 90% al 75%.
  • Permitir que hasta el 25% de la plantilla laboral esté integrada por trabajadores extranjeros, priorizando a personas migrantes en situación de vulnerabilidad.
  • Mantener la obligación de que trabajadores extranjeros y empleadores participen en la capacitación de trabajadores mexicanos.
  • Mantener excepciones para puestos de dirección, administración y gerencias generales, siempre que no se excluya a trabajadores mexicanos capacitados.

La propuesta se encuentra en etapa de iniciativa legislativa y deberá ser discutida y eventualmente aprobada por el Congreso para entrar en vigor. Hasta el momento no constituye una reforma vigente.
