United States | New “Status Change Report” for E-Verify users

Summary

The Department of Homeland Security (DHS) is revoking Employment Authorization Documents (EADs) for certain aliens whose parole has been terminated. E‑Verify has launched a new “Status Change Report” which will be regularly updated and replaces the use of Case Status Alerts for EAD revocations. Employers should monitor this report to stay updated on changes in employee work authorization and use Form I-9, Supplement B for reverification of their employees’ employment authorization.

The detail

Identification of EADs that have been revoked

DHS is revoking EADs for certain aliens whose parole has been terminated and has been sending direct notifications to some of these individuals. These revocations may be on a case-by-case basis or may be for groups, such as aliens paroled through the Processes for Cubans, Haitians, Nicaraguans, and Venezuelans (CHNV).

Previously, E-Verify provided case alerts for EADs that had been revoked. However, employers will now have to generate the “Status Change Report” to determine if their employees’ EADs have been revoked.

What should the E-Verify employers do

Employers should regularly generate the “Status Change Report” to identify if any of their employees’ EADs have been revoked as the data in this report will be regularly updated as DHS revokes EADs.

A revoked EAD does not automatically mean an employee lacks work authorization as they may hold other valid documents. Therefore, for each employee whose EAD appears as being revoked on the “Status Change Report,” the employer should request their employees to provide them with acceptable unexpired documents for the purposes of reverification of their employment authorization. Employers should use Form I-9, Supplement B for reverification and should ensure all reverifications are completed within a reasonable amount of time.

Please note that employers should not accept a revoked EAD, even if that EAD appears unexpired. In addition, employers should not create a new E-Verify case for these employees.
