United States | Judge halts Birthright Executive Order

Summary

On January 23, 2025, a US District Court Judge temporarily blocked President Donald Trump’s Executive Order aimed at ending birthright citizenship. The Judge asserted that the 14th Amendment guarantees citizenship to all individuals born in the United States, regardless of their parents’ immigration status. This ruling will halt the implementation of the Executive Order until the resolution of the lawsuits.

US District Court temporarily blocks Birthright Executive Order

On January 20, 2025, President Trump signed an Executive Order that denied citizenship to children born in the US to non-citizen parents, including those who are in the country as undocumented noncitizens or on temporary visas. This move faced immediate legal challenges from multiple states, including Washington, Arizona, Illinois, and Oregon, which argued that the 14th Amendment and Supreme Court precedents affirm birthright citizenship.  

On January 23, 2025, US District Judge John C. Coughenour issued an injunction that  temporarily blocked the Executive Order from going into effect.  The Judge’s decision halts the implementation of the Executive Order while the legal challenges proceed and until a decision on the final merits of the case is issued.  While the injunction is in place, the right to birthright citizenship in the United States remains in effect.

What this means

This is the first decision to come out on the various lawsuits that were filed against the Executive Order halting birthright citizenship.  In the coming days, we will likely see more judges making rulings on the same issue in the other district courts. While this decision temporarily halts the implementation of the Executive Order, we expect the Trump administration to appeal this decision. We will continue to monitor other pending lawsuits and any other ruling on this matter.
