The federal district court that vacated the United States Citizenship and Immigration Services (USCIS) policy on the $100,000 H-1B fee has stayed its prior decision and allowed the government to file an appeal with the Court of Appeals.
On June 8, 2026, the US District Court for the District of Massachusetts vacated USCIS’ policy on imposing a $100,000 H-1B fee on certain petitions. However, on June 12, 2026, the District Court temporarily stayed its June 8th ruling, that vacated the policy implementing the $100,000 H-1B fee. The District Court gave the Trump administration until June 18th to file its appeal with the US Court of Appeals. The District Court’s administrative stay will temporarily suspend the effect of the June 8th ruling and will allow the government to continue collecting the $100,000 H-1B fee while the appellate court considers the government’s motion for a stay of the June 8th ruling pending appeal.
