The United Kingdom Government has introduced a practical change to the Visitor Rules that is likely to be welcomed by international employers who regularly bring overseas staff to the UK for training purposes.
Prior to 8 October 2026, employees of overseas companies or organisations could receive training from a UK-based company or organisation where the training was required for their overseas employment and was unavailable in their home country.
From 8th October, the Home Office explanatory memorandum is explicit that overseas employees travelling to the UK as visitors to undertake training are no longer required to demonstrate that the same training is unavailable in their home country.
The training must still relate to the individual’s overseas employment and remain within the activities permitted under the Visitor route.
This removes a longstanding requirement that, while designed to regulate visitor activities, often created unnecessary administrative complexity for legitimate international training programmes. Employers previously needed to justify why training had to take place in the UK and provide evidence that equivalent training could not be accessed overseas.
Although the change may appear minor, it reflects a more pragmatic approach. Multinational organisations frequently need to bring employees together for company-specific training, and knowledge-sharing. The previous requirement could create additional evidential burdens without necessarily providing a clear immigration control benefit.
By removing this requirement, the UK has simplified the process for organisations seeking to deliver training to overseas employees within their UK operations.
Businesses should note that the distinction between permitted visitor activities and productive work in the UK remains unchanged. Overseas employees entering as visitors must still ensure that their activities fall within the scope of the Visitor Rules and must not undertake work that requires a work visa.
Assessing whether an activity constitutes permitted training, business activity, or productive work continues to be a key compliance consideration.
This is a positive example of the Government removing unnecessary barriers for internationally operating businesses.
At a time when discussions around immigration often focus on restrictions and labour market controls, this amendment demonstrates that targeted policy changes can both maintain immigration compliance and improve the UK’s attractiveness as a destination for international business activity and talent development.
For organisations operating global training programmes, the change should reduce administrative burden and provide greater flexibility when planning UK-based training initiatives.
