Poland | Change in the amount of salary required to obtain a Blue Card

Summary
On Friday, February 9, the Announcement of the President of the Central Statistical Office on the average salary in the national economy in 2023 was published.

The consequence of the change in the average salary is an increase in the minimum salary threshold qualifying foreign nationals to apply for a Temporary Residence Permit to perform work in a profession requiring high qualifications, the so-called Blue Card.

The Detail
Pursuant to the Act on Foreigners, the minimum salary threshold qualifying a foreign national to apply for a Blue Card is at least 150% of the average salary in the national economy in the year preceding the submission of the application.

According to the Announcement of the President of the Central Statistical Office, the average salary in 2023 was PLN 7,155.48 and is higher than in the previous year by as much as PLN 809.33.

Due to the above, from the beginning of 2024, only foreigners whose monthly gross salary is at least PLN 10,733.22 gross will be able to apply for a temporary residence permit for the purpose of performing work in a profession requiring high qualifications.

What this means
The new minimum wage threshold applies to applications submitted in 2024. This means that failure to meet this condition in applications submitted before the announcement of the new rate may result in a negative decision. The change does not apply to decisions already issued, and in these cases the employer is not obliged to update the foreigner’s remuneration in line with the changes described.
