Italy | Digital Nomad Visa introduced
Summary

The Italian Government has introduced a new Digital Nomad Visa for digital nomads and remote workers. From 5 April 2024 a new Decree applies, regulating the requirements and the procedure for entry and stay in Italy for non-EU citizens who perform highly qualified work using technological tools that enable remote work.

The detail

With Decree n. 79 of 29/02/2024, which entered into effect on 5 April 2024, the Italian government has introduced the Digital Nomad Visa for digital nomads and remote workers. The beneficiaries of this law are non-EU citizens who come to Italy as employees or self-employed persons, even for a company not established in Italy.

The Work Permit (Nulla Osta) is not required and the related Visa, beyond the annual quotas (Decreto Flussi), must be requested directly at the competent Italian Consulate abroad.

Requirements
  1. The requirements to be eligible for the Digital Nomad Visa are:
  2. Income over three times the minimum level required for exemption from national health care participation expenses (€ 8.263,31 X 3 = € 24.790);
  3. Health insurance covering the entire period of stay in Italy;
  4. Proof of accommodation in Italy in line with the minimum requirement foreseen by the Italian Law;
  5. Minimum of six months’ work experience in the same industrial sector related to the employment activity that has to be performed in Italy;
  6. Only for remote workers, an employment or self-employment contract or employment binding offer in accordance with the requirement to carrying out an activity that requires the possession of one of the requirements foreseen by the EU Blue Card:
    • three-year university degree (3 years);
    • post-secondary qualification of at least 3 years;
    • an attested higher qualification of at least 5 years professional experience ;
    • an attested higher qualification of at least 3 years professional experience (acquired within the previous 7 years) in the field of IT and communication.

Once the visa has been obtained, the non-EU citizen can travel to Italy and request a permit of stay from the competent Police Headquarters (Questura), within 8 days of arrival. The related Permit of Stay has a duration of 12 months and is renewable if the conditions are met.

In addition, the Digital Nomad Visa includes the possibility to apply for a family permit for dependents with the same duration as the main applicant.

The Immigration Office will inform the Labour and Tax Authorities of the terms and conditions of the permit. In the event of non-compliance with tax and social security obligations, the Immigration Office may revoke the permit and, in any case, will not authorize its renewal.

Depending on the country of origin, the digital nomads may benefit from a social security agreement in force with Italy, with the possibility of exemption (or partial exemption) from mandatory social security contributions.

Special tax rules could apply to digital nomads, as well as to expatriates who come to Italy with a local contract (EU Blue Card) or as an assignee (ICT).
