Czech Republic | Immigration law changes from July 1, 2024

Summary

Starting July 1, 2024, several immigration law changes will take effect in the Czech Republic. These changes will have a significant impact on employers and employees. The main changes include a new work permit waiver for certain countries and digitalization at the Labour Office.

Given the significance of the changes, it is advisable for businesses to familiarize themselves with these changes in order to be prepared.

The detail

FREE ACCESS TO THE CZECH LABOUR MARKET OPENS FOR NATIONS OF THE SPECIFIC 10 COUNTRIES

Free entry to the Czech labor market will be introduced for citizens of the following states:

• United Kingdom
• Northern Ireland
• United States
• Canada
• Australia
• New Zealand

• Japan
• South Korea
• Taiwan
• Singapore
• Israel

In practice, the nationals of these countries will not need a work permit to work in Czechia and will only be required to register at the Labour Office. Their job position will not need to be registered as vacant.

However, for employment in the Czech Republic, they will still need to obtain a permit to stay.
Depending on the length of stay, it can be a short-term visa or residence permit, typically a non-dual Employee/Blue or ICT card. Particularly those who are already legally residing in the Czech Republic and applied for a work permit can benefit, as the work permit obligation will now be abolished.

These changes are intended to facilitate and expedite the entry of foreigners who are above average pay into the Czech labour market and are generally highly qualified. The countries were selected based on general risk of security and immigration infringements (overstays), both of which were determined to be low.

CLEARER JOB CLASSIFICATIONS

Employers must specify the CZ ISCO group for job vacancies at official Labour Office website to at least three digits to help improve job matching.

NEW SANCTIONS

Job vacancies can be removed from the registry if employers don’t respond to labor office communications or aren’t located at the provided address.

THE LABOR MARKET TEST FOR VACANT POSITIONS FOR EMPLOYEE CARD IS ELIMINATED

The labor market test for vacant positions for Employee card applicants lasts 1 – 30 days. From July 1, 2024, the labor market test will be eliminated. This significantly reduces the recruitment timeline for the relocation of applicants.

At the same time, from July 1, 2024, vacancies will be published for a maximum period of 6 months. After 6 months from the announcement of the data, the position is automatically removed from the register and the employer, if he is still interested in publishing the position, can announce the position again or keep it.

In case the unemployment rate in the Czech Republic goes up, the labor market test will be reintroduced.

GET READY FOR DIGITAL EMPLOYMENT REPORTING OF FOREIGNERS

Starting July 1, 2024, the process will become fully digital as part of the ongoing efforts to digitalize the operations of Czech authorities. Here’s what you need to know:

New Reporting Channels:

• Fill out the form on the MoLSA website.

• Send an XML file to the data box of the Labor Office.

• Directly integrate your information system with the MoLSA interface.

Pro Tip: When filling out forms on the MoLSA website, be sure to save the identifier number for each form, as it’s currently the only confirmation of your submission.

Additionally, there’s a further simplification. When reporting the start or end of employment for EU nationals or those with free access to the labor market (as per §98 of Act No. 435/2004), a single form will be now used for both acts.
Stay ahead of these changes and ensure compliance with the new digital reporting requirements.
