Chile | New work authorization verification certificate for foreign nationals

Summary

The Chilean National Migration Service (Servicio Nacional de Migraciones, SERMIG) has launched a new digital Work Authorization Verification procedure, allowing foreign nationals to obtain an official certificate confirming whether they are authorized to perform remunerated activities in Chile.

For employers, the certificate may serve as an initial support tool for onboarding and immigration compliance, as it can be validated through a QR code before starting or continuing an employment relationship.

The details

The certificate can be requested through SERMIG’s digital platform and includes a QR code that allows employers to perform an initial verification of whether a foreign national’s immigration status allows them to work in Chile.

According to SERMIG, the initiative seeks to provide greater certainty to employers and foreign employees, following data validation efforts with the Chilean Pension Superintendency that identified cases of pension contributions made without corresponding work authorization.

The certificate should be treated as a compliance support document and not as a substitute for a case-by-case immigration review, particularly where the worker has pending applications, special authorizations, or unclear certificate information.

• Request and review the certificate before hiring or continuing employment with a foreign national, as part of the company’s broader immigration compliance process.
• Validate the QR code and retain evidence of the review as part of the employee’s immigration compliance file.
• Review special cases individually and seek advice where there are pending applications, short-term work authorizations, or inconsistent certificate information.

Notes

• The certificate is issued free of charge through the National Migration Service platform by selecting the “Consulta de Habilitación Laboral” option.
• After successful validation, the system generates a QR-based certificate that employers can use to verify the individual’s immigration and work authorization status.
• As the measure is recent, certificates may contain inaccuracies; both the foreign national and the employer should review the information before relying on it.
• The procedure is intended for foreign nationals whose immigration records are available in SERMIG’s systems and can be validated through the platform.
• For Transitory Permanence or other short-term authorizations, employers should confirm case by case whether the authorization is properly reflected in the certificate.

Resumen

El Servicio Nacional de Migraciones (SERMIG) anunció el nuevo trámite digital de Consulta de Habilitación Laboral, que permite a las personas extranjeras obtener un certificado oficial que confirma si están habilitadas para realizar actividades remuneradas en Chile.

Para los empleadores, este certificado puede servir como herramienta inicial de apoyo en procesos de contratación y cumplimiento migratorio, ya que puede validarse mediante código QR antes del inicio o continuidad de una relación laboral.

Detalle

El certificado puede obtenerse a través de la plataforma digital de SERMIG e incluye un código QR que permite efectuar una verificación inicial de si la situación migratoria de una persona extranjera la habilita para trabajar en Chile.

De acuerdo con SERMIG, la medida busca entregar mayor certeza a empleadores y trabajadores extranjeros, luego de procesos de validación con la Superintendencia de Pensiones que identificaron cotizaciones previsionales efectuadas sin la autorización laboral correspondiente.

El certificado debe considerarse como un documento de apoyo para fines de cumplimiento y no como sustituto de una revisión migratoria caso a caso, especialmente cuando existan solicitudes en trámite, autorizaciones especiales o información poco clara en el certificado.

• Solicitar y revisar el certificado antes de contratar o mantener la relación laboral con una persona extranjera, como parte del proceso más amplio de cumplimiento migratorio de la empresa.
• Validar el código QR y conservar respaldo de la revisión como parte del expediente de cumplimiento migratorio del trabajador.
• Revisar caso a caso situaciones especiales y solicitar asesoría cuando existan solicitudes en trámite, autorizaciones de corta duración o inconsistencias en el certificado.

Notas

• El certificado es gratuito y se obtiene en la plataforma del Servicio Nacional de Migraciones, seleccionando la opción “Consulta de Habilitación Laboral”.
• Luego de una validación exitosa, el sistema emite un certificado con código QR para verificar la situación migratoria y habilitación laboral de la persona extranjera.
• Como se trata de una medida reciente, podrían existir inconsistencias; tanto la persona extranjera como el empleador deberían revisar la información antes de basarse en ella.
• El trámite está orientado a personas extranjeras cuyos antecedentes migratorios consten en los sistemas de SERMIG y puedan validarse en la plataforma.
• Para Permanencia Transitoria u otras autorizaciones de corta duración, se recomienda confirmar caso a caso si la autorización aparece correctamente reflejada en el certificado.
