Argentina | Immigration Act No. 25.871 amendment

Summary

On 29 May 2025, the Argentine Government introduced an amendment to the Immigration Law establishing strict criteria for the admission and stay of foreign nationals, as well as changes in their access to the health and education systems.

The detail 

The National Executive Power, through Decree No. 366/2025, established significant changes in the Immigration Policy, as well as in the access of foreign nationals to the legal residency, essential public services such as health and university education and swift deportations processes.

What this means

The following are some of the most relevant points:

  • The requirements for entry and stay in the country have been tightened: strict criteria has been established to obtain the residency, including the submission of an affidavit stating the purpose of the entry into the country and commitment of regular permanence, the presentation of medical insurance and the absence of a criminal records.

Also, the new rule incorporates the obligation to register a “real domicile” at the time of entry into the country; to register a legal domicile and an “electronic domicile” for the purpose of sending all notifications.

  • Citizenship by naturalization has been modified: requirement of two years of continuous and legal residence without leaving the country is established.

Also, investment citizenship is incorporated for those who have made a relevant investment in the country.

  • Immigration and border controls will be strengthened: according to the new regulations, border rejections and penalties for irregular entries are foreseen. Swift deportation processes will be established.
  • Access to public services: free access to university education and public health care will be limited. However, access to “basic education (*)” for foreign nationals -immigrants- and health care in emergency situations is maintained. Non-emergency health care will require health insurance or prior payment.
  • (*) Education: all levels of school (Elementary, Middle and High School) are guaranteed free of charge regardless of their immigration status. University/College education will be free for Argentine nationals (native or by choice) and for foreign nationals with permanent residency.

Public universities may establish fees for education services to those students without permanent residence.
